Making All Kinds of Postures

PICTURE REMOVED BY REQUEST

The Rock OtoÄ?ec music festival, which takes place every summer near Novo Mesto,
is famous for its mud pool, especially when women roll around in it in
various states of undress. A few days ago, the official Chinese news
agency, Xinhua, published some pictures from the summer event with this hilarious caption:

 "Naked
wrestling in mud will be held in Slovenia every year. Nude females make
all kinds of postures and then begin to wrestle in the mud." (Source)

 It’s funny that they a) don’t even mention the music festival, b) use the word "will" as if naked mud wrestling was decided by government decree, c) use the phrase "make all kinds of postures," which is just intrinsically funny. (And what does it mean, exactly?)

    Hay Kurty - chill dude.  The legality of “linking” is a still in the process of working its way through the courts, as you can read in this link from Yale Law School http://research.yale.edu/lawmeme/modules.php?name=News&file=article&sid=173   Usually if the author of material linked to would rather not be linked to, all that is required is a polite request. I’ve never seen this fail.   It is also worth mentioning that Michael’s site gets over a thousand hits a day and your site probably much less. Michael’s link to your site can only increase your search engine rankings (which can’t be artificially missed with, btw). So instead of getting all hot and bothered about his link you should be a bit more grateful.  Now, the greater question here is if you have model releases from all the women you photographed, if not you may want to consider some liability insurance – if the women in question ever decide to care. Getting permission from the organizer of the event doesn’t do the trick, unless he posses these model releases and is authorized by those releases to allow a third party (that’s you) to publish them, unless your site can be considered a documentary or new report.   Peace bro.

    Thanks for clearing that up, somebody. I was alluding to the model releases in my post, but I wasn’t sure about it.I
    am going to go out on a limb and claim that Kurty does not have the
    model releases. I will further speculate that Kurty is a self-righteous
    asshole and I wish that some of those girls do decide to sue his
    pompous ass for every goddamn red cent he’s got. One can certainly not describe his request as polite.

    buy your pix), but I guess they would start laughing at you and your

    Eh fantje pa ne neumnost kvasit! Fotografije na moji spletni strani
    so avtorsko delo in ni dovoljena objava na drugih spletnih straneh brez
    soglasja. Å e najmanj je pa dovoljeno izrezati del slike in odstraniti
    logo ter objavljati kot lasten izdelek… Sem bil dovolj jasen???!p.s. za brihtneže naj si preberejo pogoje fotkanja na rock otoÄ?cu sicer se pa z puncami osebno poznam!Bo dovolj ali mislite Å¡e pametovat?

    Nisem ti oporekal tvojih avtorskih pravic. Napisal pa si vso zadevo
    zelo kretensko, glede na to da je Michael delel zate v bistvu zastonj
    reklamo.  Ce punce res poznas ali ne pa kaksni so pogoji
    za fotkanje mi v resnici dol visi. Ce jih poznas ali ne, se najbrz
    lahko odlocijo za tozbo, ce hocejo. S svojim nacinom in odnosom
    si se tukaj predstavil kot popoln kreten in nobeden od obiskovalcev si
    te ne bo zapomnil kot fotografa, ki bi ga mogoce kdaj najel. Ce se ti
    zdi taka lastna antireklama kul, pol pa itak ni problema.

    Am I missing something here? If the photos came from Xinhua or an affiliated wire service, then it is fairly safe to say that they have the right to set their own redistribution rules, based on the terms agreed to when the rights were acquired. As someone mentioned above, if Xinhua stole the pic, then Kurty should discuss the matter with them – rather than venting his anger on an individual who, based on what we know, had very reason to believe that a major wire service held all the relevant rights. Michael M. is very diligent when it comes to acknowledging people — just check any of his entries —  so Kurty’s tone is totally out-of-line. Michael has done more to promote our country with his blog than Kurty probably will in his lifetime; the very least he deserves from us is decency. And, yes, this is an English-langauge forum, with many visitors who don’t understand Slovene, so it would be courteous for people to use English when posting.

    MM je samo zlinkal sliko od kitajske agencije, kjer so oÄ?itno tvoje
    avtorsko delo nekoliko priredili. Seveda je vse to razvidno iz novice
    kitajskega vira in povezav v tej novici.
    Prav tako si ne delaj iluzij, da si ta pogovor zaÄ?el na visokem
    nivoju. Tvoja reakcija (pravzaprav bolj grožnje) je bila žaljiva in
    patetiÄ?na, nevredna dostojnega Ä?loveka.

    "MM je samo zlinkal sliko od kitajske agencije" no to ne bo držalo, ker je sliko kar lepo prenesel na svoje spletne strani…torej ne gre za linkanje iz moje ali kitajske strani. Link je bil samo dodatno naveden v textu.
    Zakaj sem urgiral? Preprosto brez dovoljenja ne dovolim objav
    mojih fotk na drugih spletnih straneh kar pa ne pomeni avtomatiÄ?no, da
    zahtevam honorar. Brez težav bi mi poslal mail in vprašal za dovoljenje
    in bi ga tudi dobil, ker ne gre za komercialno stran. Se paÄ? dogovoriÅ¡
    o pogojih objave in to je to. To je pošten odnos!Kaj
    je dovoljeno in kaj ni si lahko vsak posameznik prebere o zakonu o
    avtorskih in sorodnih pravicah RS. V Sloveniji je res kršenje avtorskih
    pravic pravi nacionalni Å¡port zato sem tudi odreagiral.  MM se tega dobro zaveda, zato je sliko tudi odstranil!LpKurty P.s. bi pa Ä?lovek glede na vse to pisanje od MM-ja priÄ?akoval javno pojasnilo…Tolk o Slovenski in Å¡e kakÅ¡ni kulturi!

    Ma, bedarija. <sicer se pa z puncami osebno poznam! Ja,
    tako da si vsaki se nasmehnil in si jo na dalec pogledal (ce pa imas od
    vsakega in vsake naslov in ves ime, pa se opravicujem). Se pa strinjam,
    da so potem se pravila RO, in tam pa je mozno, da je kje v "small
    print" zapisano, da se vsak, ki se valja v blatu v casu RO, tudi
    strinja z objavo fotk.
    MM je naredil napako s tem, da je objavil tvojo fotko (upam, da
    je ni on obrezal) in jo uploadal (fizicno) na Carniolo, ni pa nikoli
    trdil da je to njegovo avtorsko delo, saj je bil pod "avtorjem" naveden link do tvoje spletne strani…. Fotke ki je bila objavljena tudi ni bilo med "kitajskimi" fotkami, zato razumem Kurtyjev "bes". 

    Anyway. I think the Kurty’s point was right, just the communication was
    wrong. He saw that MM is from the States, and voila, lets not write him
    an email and lets not discuss with him (i’m sure the end result would
    be the same), but lets just threaten him with a lawyer. After all, this
    is an american way, isn’t it??? :)I hope Kurty also threatened Chinese the same way…And
    i guess this is also a lesson for MM… that not everything that is
    published on internet is public domain :) And that he should be very
    careful when dealing with slovenes :)

    ROCK OTOÄŒEC:
    Organizator vsako leto priredi tudi fotonateÄ?aj in je povsod
    navedeno, da se bo fotografiralo & objavilo fotografije oziroma jih
    bo organizator uporabil za promocijo festival. Avtorji lahko objavijo
    fotografije na svojih spletnih straneh ali naredijo razstavo. ÄŒe pa
    avtor želi prodati fotografije recimo agenciji za komercialne namene
    seveda potrebuje soglasje osebe na sliki.

    least those guys pay their models for showing their tits. You claim to
    know the two girls in the picture, but I doubt you know all the girls

    Rock Otocec cannot just take ownership of all the pictures of these
    girls. Besides, the rules at RO say that the pictures will be published

    photographer’s website qualifies. I never said you were not
    within your rights to request what you did. I just think you did it in
    an incredibly stupid way, considering that Michael’s website is a free
    publication. Here’s what I would have done:"Dear Micahel,Please
    make sure to reference the picture on your website by putting back the
    watermark or putting a comment ‘Photography by Kurty’ at the bottom of
    the picture. Also, please use ‘at Kurty’s website’ in the hypertext
    link that links to my site instead of ‘here’. Since a lot of
    people have already seen the picture without this referencing, could
    you also please do a story on the XYZ project that I am doing some
    time?"That would ensure yourpicture would be properly referenced
    and would even get you some more positive exposure with another story
    about your work. But such a response would require some prerequisites.
    Like a brain and a business sense.I can’t believe I spent so
    much time giving good advice to your sorry ass. Michael is a much
    smarter person than me for just ignoring you.

Yeah, right… and people accuse United States of being a land where anyone can sue anyone for stupid bullshit. Imagine that. Get a grip, man.
